Terms of Service

By accessing or using the BrokenCheats platform, software suite, Discord community, customer support systems, API endpoints, or any other service operated by BrokenCheats (collectively, the "Services"), you affirm that:

• You are at least 18 years of age, or have obtained explicit parental or guardian consent;
• You have the legal capacity to enter into a binding contract under the laws of your jurisdiction;
• You are not prohibited from receiving or using the Services under applicable law;
• You have read, understood, and agree to be bound by these Terms in their entirety;
• You will comply with all applicable local, national, and international laws, regulations, and directives;
• The information you provide to us is accurate, complete, and current at all times;
• You understand that accessing these Services may be illegal in certain jurisdictions, and you assume full responsibility for determining whether such access is lawful in your location.

These Terms apply to all users of the Services, including but not limited to users who are browsers, customers, merchants, and contributors of content. BrokenCheats reserves the right to modify, update, or replace these Terms at any time, at our sole discretion, by posting the most current version on our website. Your continued use of the Services following any revisions constitutes your acceptance of the revised Terms.

If you are accepting these Terms on behalf of a company, organization, government entity, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms, in which case "you" or "your" refers to such entity.

BrokenCheats provides proprietary software tools, enhancement modules, and associated support services designed for use with specific video game titles (the "Software"). The Software includes, but is not limited to, external overlays, internal modules, AI-assisted targeting systems, location visualization tools, voice command interfaces, anti-detection layers, and associated update delivery mechanisms.

2.1 Limited License Grant. Subject to your full compliance with these Terms and timely payment of applicable fees, BrokenCheats grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Software solely for your personal, non-commercial use during the applicable subscription period. This license does not include:

• Any right to resell, redistribute, sublicense, or commercially exploit the Software or any portion thereof;
• Any right to modify, adapt, translate, or create derivative works based on the Software;
• Any right to reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code of the Software;
• Any right to remove, alter, or obscure any proprietary notices, labels, or marks on the Software;
• Any right to use the Software to develop competing products or services;
• Any right to transfer the license to any third party, including through account sharing, resale, or gifting;
• Any right to bypass, circumvent, or disable any technological protection measures or licensing mechanisms incorporated into the Software.

2.2 HWID Binding and Device Authorization. The Software employs Hardware Identification (HWID) binding technology to enforce licensing compliance. Upon first activation, the Software captures and registers a unique hardware fingerprint derived from multiple hardware components. You are authorized to use the Software on a single hardware configuration at any one time. Any attempt to circumvent HWID binding, spoof hardware identifiers, use virtualization to bypass HWID detection, or activate the Software on multiple devices simultaneously constitutes a material breach of these Terms and will result in immediate license termination without refund.

2.3 HWID Resets. BrokenCheats may, at its sole discretion, grant HWID reset requests in cases of legitimate hardware upgrades or replacements. HWID resets are not guaranteed and are subject to review. Abuse of the HWID reset system, including frequent requests, fraudulent hardware change claims, or resets obtained through false pretenses, will result in permanent account termination.

2.4 Software Updates and Modifications. BrokenCheats reserves the right to modify, update, patch, suspend, or discontinue the Software or any feature thereof at any time, with or without notice. We may require you to install updates as a condition of continued use. BrokenCheats is not liable for any modifications made to the Software, any interruptions in service resulting from updates, or any failure to provide updates.

2.5 Third-Party Components. The Software may incorporate third-party open-source or commercial components. Your use of such components is subject to the respective third-party licenses. BrokenCheats does not warrant or accept liability for any third-party components.

3.1 Account Creation. To access most Services, you must create an account by providing a valid email address, creating a secure password, and completing any required verification procedures. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary.

3.2 Account Security. You are solely responsible for maintaining the confidentiality of your account credentials. You agree to:

• Select a strong, unique password that you do not use on other services;
• Enable any available two-factor authentication mechanisms;
• Immediately notify BrokenCheats of any unauthorized use of your account or any other security breach;
• Ensure that you log out of your account at the end of each session, particularly when using shared devices;
• Never share your account credentials with any third party.

BrokenCheats will not be liable for any loss or damage arising from your failure to comply with these account security obligations. You accept liability for all activities that occur under your account, whether or not authorized by you.

3.3 Account Prohibition on Sharing. Each account is licensed for use by a single individual. Account sharing, whether gratuitous or commercial, is strictly prohibited. Discovery of account sharing will result in immediate and permanent account termination without refund or recourse.

3.4 Account Transferability. Accounts are non-transferable. You may not sell, trade, auction, gift, or otherwise transfer your account or any associated licenses to any third party. Any purported transfer is null and void.

3.5 Inactive Accounts. BrokenCheats reserves the right to terminate or deactivate accounts that have been inactive for an extended period, subject to applicable laws. We will endeavor to provide advance notice where feasible.

3.6 Multiple Accounts. Creating multiple accounts to circumvent bans, accumulate trial benefits, avoid account restrictions, or engage in any form of fraud is strictly prohibited and will result in permanent termination of all associated accounts.

4.1 Payment Obligation. By purchasing a subscription or license, you agree to pay all applicable fees in accordance with the pricing displayed at the time of purchase. All prices are stated in the currency displayed on our platform.

4.2 Accepted Payment Methods. BrokenCheats accepts payments through designated payment gateways, including but not limited to EasyPaisa, JazzCash, SadaPay, Binance Pay, and cryptocurrency payment processors. We reserve the right to modify accepted payment methods at any time.

4.3 Payment Verification. All transactions are subject to verification by BrokenCheats staff. You must provide accurate transaction IDs and payment screenshots upon request. Failure to provide adequate payment proof within 48 hours of purchase may result in order cancellation.

4.4 Subscription Terms. Subscriptions are activated upon payment confirmation by authorized staff. Subscription periods are non-extendable due to delays caused by the user, including failure to provide payment proof, incorrect payment details, or failure to respond to staff inquiries.

4.5 Price Changes. BrokenCheats reserves the right to change pricing at any time without notice. Price changes will not affect currently active subscription periods.

4.6 Refund Policy. Due to the digital and immediately-deliverable nature of our products, ALL SALES ARE FINAL. BrokenCheats does not offer refunds, exchanges, or credits except in the following limited circumstances, at our sole discretion:

• The Software is fundamentally non-functional due to a verified technical defect attributable solely to BrokenCheats;
• A duplicate charge occurred due to a payment processing error;
• The purchased product was formally discontinued before delivery.

Refund requests based on game bans, anti-cheat detections, changes in personal preference, failure to read product descriptions, incompatibility with non-specified hardware, or third-party software conflicts will not be considered.

4.7 Chargebacks and Disputes. Initiating a chargeback, payment dispute, or reversal through your bank or payment provider is considered fraud and a material breach of these Terms. You agree that in the event of a chargeback, BrokenCheats is entitled to immediately terminate your account, blacklist your hardware, and pursue recovery of all amounts owed, including associated fees and costs. BrokenCheats reserves the right to report fraudulent chargebacks to relevant authorities.

4.8 Taxes. You are solely responsible for all applicable taxes, duties, and levies associated with your purchase. BrokenCheats does not collect taxes on behalf of governmental authorities except where required by law.

4.9 Currency and Conversion. In cases where payment is made in currencies other than the listed currency, conversion rates are determined at the time of payment. BrokenCheats is not responsible for currency fluctuations or conversion fees charged by payment providers.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You expressly agree not to:

• Use the Services for any purpose that is unlawful or prohibited by these Terms;
• Attempt to gain unauthorized access to any portion of the Services or any related systems, networks, or servers;
• Circumvent, disable, or otherwise interfere with security-related features of the Services;
• Upload, transmit, or distribute any viruses, malware, spyware, ransomware, or any other malicious code;
• Conduct automated queries, screen scraping, or data mining of the Services without express written consent;
• Use the Services to harass, threaten, defame, or otherwise harm other users or staff members;
• Impersonate BrokenCheats staff, other users, or any third party;
• Post, transmit, or otherwise distribute content that is defamatory, obscene, fraudulent, or otherwise objectionable;
• Attempt to reverse engineer, decompile, or disassemble any portion of the Software;
• Interfere with or disrupt the integrity or performance of the Services;
• Engage in any activity that imposes an unreasonable or disproportionately large load on our infrastructure;
• Resell, redistribute, or commercially exploit the Software or access to the Services without authorization;
• Use the Services to develop, test, or market any software that competes with BrokenCheats products;
• Exploit bugs, errors, or vulnerabilities in the Software for personal gain or to disrupt service;
• Engage in any form of social engineering targeting BrokenCheats staff or other users;
• Make false or fraudulent purchase claims, payment claims, or support claims;
• Publicize, leak, or disclose internal communications, staff discussions, or confidential technical information;
• Organize or participate in coordinated attacks against BrokenCheats platforms, including DDoS attacks, spam campaigns, or reputation attacks.

Violation of this Acceptable Use Policy may result in immediate account termination, permanent hardware bans, and legal action where applicable.

6.1 Risk Acknowledgment. You fully understand, acknowledge, and accept that:

• The Software is designed to modify or supplement the gameplay experience in online video games and may violate the Terms of Service or End User License Agreements of the respective games ("Game ToS");
• Game developers and anti-cheat providers continually update their detection systems. No software can guarantee permanent immunity from detection;
• Use of the Software carries an inherent risk of in-game account bans, hardware bans (HWID bans), IP bans, UID bans, or other disciplinary actions imposed by game developers or anti-cheat systems;
• BrokenCheats does not guarantee, warrant, or represent that the Software is or will remain undetected by any specific anti-cheat system;
• Game bans, account suspensions, or hardware bans resulting from the use of the Software are not grounds for refunds or compensation;
• You are solely responsible for determining the legality of using the Software in your jurisdiction;
• We recommend not using the Software on accounts with significant monetary value, rare cosmetics, or irreplaceable game progress.

6.2 No Warranty on Detection Safety. While BrokenCheats employs extensive anti-detection techniques and continuously updates the Software to minimize detection risk, we make no warranty, express or implied, regarding the detection status of the Software. The phrase "undetected" or similar language in our marketing materials refers to the current known status at the time of publication and is not a guarantee of future detection status.

6.3 Status Updates. BrokenCheats may, at its discretion, provide status updates regarding the safety of the Software through its official channels. You agree to monitor these channels and act accordingly. BrokenCheats is not liable for any damages arising from your failure to monitor status updates.

7.1 Ownership. The Services and all content, features, and functionality thereof — including but not limited to the Software, source code, object code, algorithms, user interface designs, graphics, logos, trademarks, trade secrets, proprietary methodologies, and documentation — are owned exclusively by BrokenCheats and are protected by applicable intellectual property laws.

7.2 User Content. By submitting any content to BrokenCheats (including support tickets, feedback, screenshots, or suggestions), you grant BrokenCheats a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, publish, and distribute such content in connection with operating and improving our Services.

7.3 Feedback. Any feedback, suggestions, or recommendations you provide regarding the Services may be used by BrokenCheats without restriction and without any obligation of confidentiality or compensation to you.

7.4 Trademark Use. The BrokenCheats name, logo, and all associated trademarks and service marks are proprietary to BrokenCheats. You may not use these marks in any manner without our prior written consent.

7.5 DMCA Compliance. BrokenCheats respects intellectual property rights. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide a written notice to our designated agent with the information required under the Digital Millennium Copyright Act (DMCA).

8.1 Termination by BrokenCheats. We reserve the right to terminate or suspend your account and access to the Services at any time, with or without cause, with or without notice, effective immediately. Grounds for termination include but are not limited to:

• Any breach of these Terms;
• Fraudulent chargebacks or payment disputes;
• Attempting to crack, reverse engineer, or pirate the Software;
• Account sharing or HWID spoofing;
• Harassment, threats, or disrespectful conduct toward staff or other users;
• Violating the Acceptable Use Policy;
• Any activity deemed harmful to BrokenCheats, its reputation, or its users;
• Leaking confidential information, internal communications, or proprietary data;
• Coordinating or participating in attacks against our services;
• Providing false information during registration or transactions.

8.2 Permanent Hardware Bans. In cases of severe violation, BrokenCheats may implement a permanent hardware ban, blacklisting your device's hardware identifiers. Hardware-banned users may not create new accounts, use alternative payment methods to repurchase, or seek reinstatement except through a formal appeal process at BrokenCheats' sole discretion.

8.3 No Refund on Termination. Upon termination of your account for any reason, you will not be entitled to any refund of fees paid, regardless of the remaining subscription period.

8.4 Effect of Termination. Upon termination: (a) all licenses granted to you terminate immediately; (b) you must immediately uninstall and delete all copies of the Software; (c) any outstanding payment obligations remain in effect; (d) all provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8.5 Termination by User. You may terminate your account at any time by contacting BrokenCheats support. Termination does not entitle you to a refund of any fees paid.

8.6 Appeals Process. You may appeal account terminations or bans through our official support channels. All appeal decisions are made at the sole discretion of BrokenCheats senior staff. We reserve the right to reject appeals from users who have committed severe violations, including fraud, piracy, or coordinated attacks.

THE SERVICES AND SOFTWARE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BROKENCHEATS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
• WARRANTIES THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;
• WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR CONTENT OF ANY INFORMATION OR DATA OBTAINED THROUGH THE SERVICES;
• WARRANTIES THAT DEFECTS, IF ANY, WILL BE CORRECTED;
• WARRANTIES THAT THE SOFTWARE WILL REMAIN UNDETECTED BY ANY ANTI-CHEAT SYSTEM.

BrokenCheats does not warrant that files available for download will be free of viruses, worms, Trojan horses, or other destructive programming. You are responsible for implementing appropriate safeguards for the protection of your data and information.

Some jurisdictions do not allow the exclusion of certain warranties. In such cases, some of the above exclusions may not apply to you.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BROKENCHEATS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR ANTICIPATED SAVINGS;
• DAMAGE TO REPUTATION OR DIGITAL ASSETS;
• LOSS OF GAME ACCOUNTS, IN-GAME ITEMS, PROGRESS, OR ANY DIGITAL GOODS;
• COSTS OF SUBSTITUTE PRODUCTS OR SERVICES;
• BUSINESS INTERRUPTION;
• ANY MATTER BEYOND OUR REASONABLE CONTROL.

THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF BROKENCHEATS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS WHERE LIMITATION OF LIABILITY IS PERMITTED, BROKENCHEATS' TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO BROKENCHEATS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to defend, indemnify, and hold harmless BrokenCheats, its affiliates, licensors, service providers, employees, agents, officers, directors, and successors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms;
• Your use or misuse of the Services;
• Your violation of any applicable law or regulation;
• Your violation of any third party's rights, including intellectual property rights, privacy rights, or proprietary rights;
• Any claims by third parties arising from your use of the Services;
• Any content you submit, post, or transmit through the Services;
• Any dispute between you and another user of the Services.

BrokenCheats reserves the right to assume exclusive control of the defense of any matter for which you are required to indemnify us, at your expense. You agree to cooperate fully with such defense.

12.1 Informal Resolution. Before initiating formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting BrokenCheats through official support channels. We will attempt to resolve the dispute informally within 30 days of receiving your complaint.

12.2 Binding Arbitration. If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms, including questions regarding its existence, validity, or termination, shall be submitted to and finally resolved by binding arbitration. You waive any right to a jury trial or participation in a class action lawsuit. The arbitration shall be conducted by a mutually agreed-upon arbitrator or arbitration service.

12.3 Class Action Waiver. You agree that any proceedings to resolve or litigate any dispute shall be conducted solely on an individual basis. You waive any right to bring claims as a plaintiff or class member in any purported class action, collective action, or private attorney general action.

12.4 Governing Law. These Terms shall be governed by and construed in accordance with applicable law. You consent to the exclusive jurisdiction and venue of applicable courts for any claims that may not be subject to arbitration.

12.5 Limitation Period. Any claims arising under these Terms must be brought within one (1) year of the date the cause of action accrued, or such claims shall be permanently barred.

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to our collection, use, and disclosure of your information as described in the Privacy Policy. You acknowledge that the Software may collect hardware identification data, system information, usage statistics, and other diagnostic data as described in the Privacy Policy and necessary for licensing enforcement and service improvement.

14.1 Discord Community. BrokenCheats operates official Discord servers as supplemental support and community channels. Your participation in these communities is subject to these Terms as well as Discord's Terms of Service.

14.2 Prohibited Conduct in Community Channels. In BrokenCheats community channels, you agree not to:

• Post spam, unsolicited advertisements, or promotional content;
• Share, distribute, or link to cracked, pirated, or unauthorized versions of the Software;
• Harass, intimidate, or disrespect other members or staff;
• Share confidential technical information, detection reports, or internal discussions;
• Attempt to impersonate staff or official BrokenCheats accounts;
• Organize raids, mass reporting campaigns, or coordinated harassment;
• Discuss competitors' products in a manner intended to undermine BrokenCheats;
• Post NSFW, offensive, or illegal content.

Violations of community standards may result in mutes, kicks, bans from community channels, and/or termination of your Service account at BrokenCheats' sole discretion.

BrokenCheats shall not be held liable for any failure or delay in performance of its obligations under these Terms resulting from causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemic, epidemic, war, terrorism, riot, civil commotion, government actions or regulations, labor disputes, power outages, internet disruptions, cyberattacks, infrastructure failures, or any other event that BrokenCheats could not reasonably have anticipated or prevented.

BrokenCheats reserves the right to modify, suspend, or discontinue any aspect of the Services at any time, including the availability of any feature, database, or content. We may also impose limits on certain features and services or restrict your access to parts or all of the Services, with or without notice and without liability to you. We may add new features or functionality to the Services from time to time, which shall be subject to these Terms.

Our Services may contain links to third-party websites, applications, or services that are not owned or controlled by BrokenCheats. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that BrokenCheats shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

These Terms, together with the Privacy Policy, Cookie Policy, Refund Policy, and any other agreements or policies incorporated herein by reference, constitute the entire agreement between you and BrokenCheats with respect to the Services and supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether oral or written, between you and BrokenCheats regarding the Services.

No waiver by BrokenCheats of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of BrokenCheats to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
